Each mobile food unit and commissary must be permitted separately. *Health Permits Are Non-Transferable*
Each mobile food unit must also operate out of a permitted Commissary location with an approved Servicing Area. This is a pre-requisite for mobile food units.
MOBILE FOOD UNIT Permits
- Mobile Food Units will display a NET Health permit sticker in a visible location on the front and rear of the truck.
- All permits must be renewed each year. *Health Permits Are Non-Transferable to other owners*

PUSH CARTS Permits
- Push Carts will display a NET Health permit sticker on two sides of the push cart.
- All permits must be renewed each year. *Health Permits Are Non-Transferable to other owners*

Opening a Mobile food Business is a two-step process
Step 1 – The Preliminary Plan Review of Your Business

- Payment of the Plan Review Fee: $200.00
- Submission of Step 1 Application, Menu, Floor Plan, Business Plan, and Equipment Spec Sheets
- Review. All consultation regarding construction requirements and permitting
- Creation of a File and Collection of Documentation of the Business
- TX Sales Tax ID
- Ownership Documents
- Menu
- Accurate, scaled drawings of Mobile Food Unit
- All equipment installed on board the mobile unit must be approved for its intended use. provided
- Preliminary Inspection of Mobile Food Unit at the Environmental Health Office located at 815 N. Broadway Avenue in Tyler
- The operator then must schedule a full inspection with the Fire Marshal, and must show a passed inspecion when returning to NET Health for Step 2 (see below)
- A punch list is issued delineating repairs and requirements necessary to bring the Mobile Food Unit into compliance.
- The local Fire Marshal is also scheduled to inspect the vehicle during this inspection. Any deficiencies in Fire Safety will be issued for correction during this inspection.
Step 2 - Application for Annual Food Permit. This application is issued during the preliminary inspection
After the preliminary is completed, the applicant will complete any repairs, fill out the Step 2 permit application and submit any remaining documents necessary to complete the account file at least three business days prior to an expected permitting inspection. NET Health will then coordinate a time to schedule the permitting inspection for the vehicle in the Environmental Health parking lot located at 815 N. Broadway Ave. Tyler, TX 75702.
**Important Note** A permitted Commissary Location is required to be approved and/or permitted for the mobile unit prior to a Step 2 Permitting Inspection to be scheduled.
Where to go after obtaining an Annual Mobile Food Permit
After a NET Health Mobile Food Unit Permit has been obtained, the mobile food unit is approved to serve food anywhere in NET Health jurisdiction (all of Smith County and all of the City Limits of Bullard). It is crucial that the mobile food unit go to each city hall and seek approval to sell because each city will have different rules for business licenses, zoning restrictions and other specific limitations for mobile food.
If you travel outside of NET Health's jurisdiction, you will need to check in with the Retail Food Inspections Division at your destination location to obtain a valid Food Permit in that area.
